Privacy Policy

Effective Date: May 20, 2026

Last Updated: May 20, 2026

1. Introduction

Contractor Whale ("we," "us," or "our") operates the Contractor Whale platform located at contractorwhale.com (the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect your information when you use our Service. By using the Service, you agree to the collection and use of information in accordance with this policy.

2. Information We Collect

We collect information you provide directly to us, including:

  • Name, email address, and password when you register an account
  • Mobile phone number (optional, provided at signup or in your account profile)
  • Billing information (processed securely through our payment provider)
  • Business name, trade type, and county preferences you enter in your profile
  • Communications you send to our support team

We also collect certain information automatically when you use the Service, including IP address, browser type, pages visited, and referring URLs.

3. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and improve the Service
  • Deliver your weekly lead digests and notifications
  • Process transactions and send related information
  • Respond to comments, questions, and support requests
  • Send administrative messages, updates, and promotional communications (you may opt out at any time)
  • Monitor and analyze usage and trends to improve your experience

4. Sharing of Information

We do not sell, trade, or rent your personal information to third parties. We do not share your data with third parties for marketing purposes. We may share information in the following limited circumstances:

  • Service Providers: We may share information with vendors and service providers who perform services on our behalf (e.g., payment processing, email delivery, analytics).
  • Legal Requirements: We may disclose information if required by law or in response to valid legal process.
  • Business Transfers: In connection with a merger, acquisition, or sale of assets, your information may be transferred as a business asset.

5. Data Sources

Contractor Whale delivers leads sourced from public records in the markets we serve (currently Texas and Wisconsin), including building permit filings, warranty deed transfers, and home sale records. These records are publicly available information collected from county and municipal government databases. We do not sell or share any personally identifiable information of the homeowners or property owners contained in these records.

6. Data Security

We implement reasonable technical and organizational measures to protect your information against unauthorized access, loss, or misuse. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

7. Data Retention

We retain your personal information for as long as your account is active or as necessary to provide the Service. You may request deletion of your account and associated data by contacting us at support@contractorwhale.com.

8. Your Rights

Depending on your location, you may have rights to access, correct, or delete your personal information, or to object to or restrict certain processing. To exercise these rights, contact us at support@contractorwhale.com.

9. Cookies

We use cookies and similar tracking technologies to operate and improve the Service. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Service may not function properly without cookies.

10. Children's Privacy

The Service is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have collected such information, we will take steps to delete it promptly.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the new policy on this page and updating the effective date. Your continued use of the Service after changes become effective constitutes your acceptance of the revised policy.

12. Phone Numbers & SMS Data

  • Collection. The phone field at signup is optional. We collect your mobile number only if you provide it.
  • Use — transactional SMS (signup consent). If you opt in by checking the SMS consent box at signup, we may use your number to send transactional messages only: account alerts, digest delivery notifications, billing notices, password reset and security confirmations, and other service-related communications. The signup checkbox does not grant marketing consent.
  • Use — marketing SMS (separate opt-in). Marketing messages — promotions, new feature announcements, upsells, and other commercial communications — require a separate opt-in available in your account settings. We will not send marketing SMS unless you explicitly enable that category, and your signup-form SMS consent alone is never treated as marketing consent.
  • We do not share your data with third parties for marketing purposes. Mobile numbers are never sold, rented, or shared with third parties for their own marketing.
  • Service providers. We share your phone number only with our SMS delivery vendor (currently Aloware) solely to deliver the messages you've opted in to receive.
  • Retention. We retain your phone number for the lifetime of your account plus 90 days after closure, then purge. Consent records (per-category timestamp, IP, opt-out events) are retained for 4 years to meet TCPA recordkeeping requirements.
  • Opt out. Reply STOP to any text message to immediately unsubscribe from any SMS category (transactional or marketing). Reply HELP for support contact information. You may also remove your phone number from your account profile at any time.

13. Job Applications (Whale Hire)

We operate recruiting pages (under /hiring/) on behalf of local contracting companies that are hiring. If you apply through one of these pages:

  • Collection. We collect the information you submit on the application form — your name, phone number, email, preferred work area, your answers to screening questions, any notes you add, and the resume file you upload.
  • Use. We use this information solely to evaluate your application, conduct pre-interviews, and — if you're a strong match — introduce you to the hiring company that the page was created for.
  • Sharing. Your application and resume may be shared with the specific hiring company (or companies) relevant to the position you applied for. We do not sell applicant data or share it with unrelated third parties.
  • Storage & security. Resumes are stored in access-controlled cloud storage and are not publicly accessible; downloads require authenticated, time-limited links.
  • Retention. We retain applications and resumes for up to 2 years so we can consider you for future openings, unless you ask us to delete them sooner.
  • Your rights. You may request access to, correction of, or deletion of your application data at any time by contacting us at the address below.

14. Advertising Pixels

Some of our public pages — including Whale Hire recruiting pages — may include advertising pixels (such as the Nextdoor Pixel) that help us measure the effectiveness of our ads.

  • What they collect. Pixels may record that you visited a page or completed an action (such as submitting an application form), along with standard technical data like your IP address, browser type, and cookie identifiers set by the advertising platform.
  • Who receives it. This data is transmitted to the advertising platform (e.g., Nextdoor) and handled under that platform's own privacy policy and advertising terms. Pixels do not transmit the contents of your application, your answers, or your resume.
  • Global Privacy Control. We honor the Global Privacy Control (GPC) browser signal — when your browser sends GPC, we do not load advertising pixels on these pages.
  • Your choices. You can also block pixels using browser tracking protection, ad blockers, or by adjusting your ad preferences on the relevant advertising platform.
